Notice - Citizen Value Adjustment Board Member Notice

"Pursuant to the provision of Chapter 194.015 of the Florida Statutes, the Clerk of the Value Adjustment Board is now accepting applications from any citizen, owning a homesteaded property within Monroe County, wishing to participate as a citizen member on the Value Adjustment Board. The citizen may not be a member or an employee of any taxing authority, and may not be a person who represents property owners in any administrative or judicial review of property taxes. By statute, the Board of County Commissioners is limited to appointment of only one citizen member to the Value Adjustment Board."

Notice - Clarification To Advisory Bulletin 06-28

"Any person preparing or filing a court document should not include a social security number or a complete bank account, debit, charge, or credit card number in such document, unless required by law or court rule, or necessary to the adjudication of the case.

Any person has a right to request that the Clerk of the Circuit Court remove from an image or copy of a court document a social security number or complete bank account, debit, charge, or credit card number contained in a court document. Such request must be made in writing and delivered by mail, facsimile, electronic transmission, or in person to the Clerk of the Circuit Court. The request must specify the case number, the title of the document, and the identification page number of the document which contains the number to be redacted. A fee will not be charged for the redaction of a social security number of a complete bank account, debit, charge, or credit card number pursuant to such a request."

Notice - Under Florida law, e-mail addresses are public records

Under Florida law, e-mail addresses are public records. If you do not want your e-mail address released in response to a public-records request, do not send electronic mail to this entity. Instead contact this office by phone or in writing.

Notice - Additional $4.00 Per Page Recording Charge

The 2004 Florida Legislature has adopted SB2962, which provides:

"Effective June 1, 2004, an additional service charge of $4 per page shall be paid to the clerk of the circuit court for each instrument listed in section 28.222, Florida Statutes, except for a judgment received from the court or a notice of lis pendens, recorded in the official records. The funds collected shall be remitted to the Department of Revenue for deposit into the Clerks of the Court Trust Fund for appropriation by law for the purpose of addressing cash-flow problems that may arise in clerk of the court offices during July and August of 2004, and shall be distributed pursuant to the provisions of section 28.36, Florida Statutes."

Notice - Social Security Number, bank account number, charge, debit, or credit card number

The 2002 Florida Legislature has adopted HB1673, HB 1675, and SB 24-E, which provides:

"Any person who prepares or files a document to be recorded in the official records by the county recorder as provided in chapter 28, Florida Statutes, may not include a person's social security number or complete bank account, debit, charge, or credit card number in that document unless otherwise expressly required by law."

and further provides:

"Any person, or his or her attorney or legal guardian, may request that a county recorder remove from an image or copy of an official record placed on a county recorder's publicly available Internet website, or a publicly available Internet website used by a county recorder to display public records outside the office or otherwise made electronically available outside the county recorder's office to the general public, his or her social security number or complete account, debit charge, or credit card number contained in that offical record. Such request must be legibly written, signed by the requestor, and delivered by mail, facsimile, electronic transmission, or in person to the county recorder. The request must specify the identification page number of the document that contains the number to be redacted. The county recorder does not have a duty to inquire beyond the written request to verify the identity of a person requesting redaction. A fee may not be charged for redacting such numbers."

Notice - Military Discharge, Death Certificate, Family Law, Juvenile and Probate

The 2002 Florida Legislature has adopted HB1679, which provides:

"No county recorder or clerk of the court may place an image or copy of a public record, including an official record, on a publicly available Internet website for general public display if that image or copy is of a military discharge; death certificate; or a court file, record, or paper relating to matters or cases governed by the Florida Rules of Family Law, the Florida Rules of Juvenile Procedure, or the Florida Probate Rules.

Any records specified in this subsection made available by the county recorder or clerk of the court on a publicly available Internet website for general public display prior to the effective date of this act must be removed if the affected party identifies the record and requests that it be removed. Such request must be in writing and delivered by mail, fascimile, or electronic transmission, or in person to the county recorder or clerk of the court. The request must specify the identification page number of the document to be removed. No fee may be charged for the removal of a document pursuant to such request."

Florida law requires that images and copies of the above listed documents remain on file and available to the public upon request in the Office of the Clerk/County Recorder.

Notice - Veteran forms DD-214, DD-215, WD AGO 53, WD AGO 55, WD AGO 53-55, NAVMC 78-PC and NAVPERS 553

The 2002 Florida Legislature has adopted Senate Bill 24-E, which provides:

"Any veteran of the United States Armed Forces or his or her widow or widower, attorney, personal representative, executor, or court appointed guardian has the right to request that a county recorder remove from the official records any of the following forms recorded before, on, or after the effective date of this act, by or on behalf of the requesting veteran: DD-214; DD-215; WD AGO 53; WD AGO 55; WD AGO 53-55; NAVMC 78-PD; and NAVPERS 553. The request must specify the identification page number of the form to be removed. The request shall be made in person and with appropiate identification to allow determination of the identity of the requested. The county recorder has no duty to inquire beyond the request to verify the identity of the person requesting the removal. No fee shall be charged for the removal"
